Claiming compensation for chromium related illness

Chromium itself is a stable element and is not thought to pose any particular health risk to humans. However, some chromium compounds such as chromium trioxide and chromic acid are considered toxic and workers who are exposed to them may develop chromium related illness.

Who is at risk of chromium related illness?
Workers who are most at risk of chromium poisoning include:

  • those involved in stainless steel and chromium alloy manufacture;
  • wood preservative manufacture workers;
  • electroplating workers;
  • anodising workers;
  • chemical catalyst workers;
  • pigment production workers; and
  • dyestuff workers.

How does chromium related illness occur?
If workers are not provided with suitable protective clothing and equipment and they breathe in chromium fumes, experience dermal contact or ingest the substance, they may develop chromium related illness. Many cases of exposure occur where workers eat, drink or smoke in chromium-contaminated spaces.

What are the symptoms?
There are a wide variety of chromium poisoning symptoms. These include:

  • dermal burns;
  • optical damage; and
  • respiratory problems;

If long-term exposure and damage occur, workers may develop renal failure, lung damage, septum damage and, in some extreme cases, cancers of the lung and nose.

Blood tests, urinalysis and liver tests are the common diagnostic tools for testing for chromium poisoning.

In cases of low level poisoning, separating a worker from the source of exposure should result in a return to normal health. However, in more extreme cases, serious health complications may develop and may sometimes even prove fatal.

Making a compensation claim for chromium related illness
Under the Control of Substances Hazardous to Health Regulations employers have a duty to ensure that workers do not suffer exposure to Chromium V1 above the maximum exposure limit
(MEL) of 0.05mg/m3 averaged over an 8 hour day; for other chromium compounds, the exposure standard (OES) is 0.5mg/m3 averaged over an 8 hour day.

Furthermore, they are obliged to ensure that there are full risk assessments, monitored exposure, suitable protective equipment and regular health checks.
