It is a sad fact but when a fatal work accident occurs it is often the time when employers and management teams decide to look closely at their safety procedures - and this is of course too late.
In May 2009, the University of California, Los Angeles (UCLA) was fined almost $32,000 (£21,340) after a chemical accident in a laboratory in December 2008 caused the death of a female researcher.
The 23-year-old had been working with t-butyl lithium, a highly flammable compound that will spontaneously combust on exposure to air, when a problem with equipment led to a fire and the researcher suffered third degree burns to 43% of her body. She died three weeks after the accident.
The California Division of Occupational Safety and Health (Cal/OSHA) made a report on the work accident and noted that the young woman had not been wearing appropriate protective clothing. The report also stated that the university's storage of flammable solvents fell below what was required by the National Fire Protection Association's limit.
Cal/OSHA reported a lack of training records regarding health and safety provision for lab staff. However, UCLA maintained that the researcher had received training in general lab safety, and for the procedure she was carrying out, but that the training had not been recorded.
An expert for the American Chemical Society's chemical health and safety division suggested there would be a strong case for a compensation claim against the university for the wrongful death of the young woman as a result of negligence on the part of UCLA.
He said, "[After the report] I suspect there were many, many schools that took a closer look at their own safety programmes and training documentation.
"The only silver lining that ever comes out of a case like this is increased awareness."
