High winds such as those of around 70 mph and above can lead to extremely hazardous driving conditions and may lead to vehicles being blown off course, potentially into the path of other vehicles, or may cause debris to be blown across roads and motorways. The scope of such hazards is only increased when heavy vehicles such as HGVs are involved and there are several situations in which no win, no fee compensation may be payable for a lorry accident in high winds.
Firstly, the driver of a lorry may be entitled to receive work accident compensation if it can be shown that his employer was in some way liable for the incident.
This situation may arise if it can be shown that the employer has placed undue pressure on the driver to take to the road in high winds. Additionally, sums may be payable if it can be argued by a no win, no fee solicitor that the driver has had inadequate training or has not been provided with sufficient safety equipment, such as wind deflectors.

After receiving his settlement, the claimant commented, "I wanted to highlight the dangers posed to haulage companies in high winds and want to prevent similar accidents from happening again in the future."
However, it is not only lorry drivers who may be able to claim compensation for a lorry accident in high winds; the drivers of other vehicles may also be entitled to sums in the event they have become involved in a wind-related accident with an HGV.
For example, in 2009 the driver of a BMW made a successful claim after suffering fractures, cuts and bruises when his car was forced off the road into a ditch by a lorry which rolled over in high winds near Yorkshire.
