Sometimes a car accident injury can be caused or at least exacerbated by a fault or defect in a vehicle.
Although it is probably the most notorious, the mass global recall of certain Toyota models in 2010 is also the most notable example of this. Car accident injury compensation settlements were offered to many motorists who had suffered crashes caused by design and technical defects relating to accelerator pedals.
However, injuries may also sometimes be caused by cosmetic aspects of a car's design. A very good example of this is the metal "Flying B badge" on luxury Bentley automobiles.
During the 1970s this iconic part of the car was removed from all vehicles manufactured by Bentley. This was because of concerns that it had the potential to increase the risk of personal injury and damage caused by car crashes, particularly those which involve pedestrians. This was because the Flying B badge, which protruded from the foremost point of the bonnet, presented a serious impalement risk.
However, six years into the 21st century Bentley decided that, because technology allowed it to do so, it would resurrect the iconic badge. Instead of having a static motif, Bentley fitted its vehicles, which typically costed between £200,000 and £250,000, with a retractable version that swiftly slips back into the bonnet in the event of impact or collision.
It later turned out that this faith in technology proved to be misguided. In 2010 the manufacturer announced a global recall of around 1,500 cars after it was discovered that water could seep into the retraction system, causing it to corrode and lose its ability to withdraw.
A Bentley spokesperson commented, "In a small number of cases, it means that springs and levers will not retract it as quickly as we would like."
Fortunately, Bentley reported that there was no evidence of any pedestrians having suffered accidents or injuries as a result of the fault.
A spokesperson from no win, no fee compensation leader YouClaim comments, "Incidents like the one involving Bentley and the one involving Toyota, although very different in scope and seriousness, highlight the need to ensure that manufacturers have prompt and effective recall systems to prevent serious product liability claims for injuries caused by automotive manufacturer defects."
