Road accidents caused by stray animals

Road accidents can often be caused by livestock that has somehow managed to escape the confinements of its owner's private property and made its way onto our UK highways. It can be extremely distressing for any driver who is travelling into the path of a stray animal and they will of course do anything they can to avoid hitting the creature.

This quick and compassionate action can sometimes cause devastating road accidents, inflicting serious personal injuries to the driver and their passengers. A number of accidents have been reported where drivers have collided with verges, road signs and central reservations because they have swerved their vehicle in a bid to avoid killing an animal and many of them could have made compensation claims for their car accident injuries.

Livestock liability
The owners of livestock such as sheep, cows and pigs have a responsibility to make sure that their animals cannot escape and stray onto roads where they could potentially cause a serious road traffic accident.

If it can be proven that an owner has failed to secure their livestock and failed to carry out a duty of maintaining safe surroundings for road users they could face injury compensation claims being made against them by the injured party involved in the vehicle accident.

Liability for pets
In 2006, 101,586 stray dogs were reported to have been found throughout the UK, fortunately, with the help of microchips, 29% of those dogs were reunited with their owners. With so many stray dogs, it would seem inevitable that road accidents might occur but who would you make a car accident compensation claim against?

The same rule applies for pets as it does for livestock: if it can be proven that an owner has been unable to control their pet from venturing onto a highway and it causes a serious car accident, they would be liable for the crash meaning that anyone who had suffered as a result of the stray animal would be justified in contact a no win, no fee solicitors with a view to making an accident claim.

If you manage to make an accident claim against a dog's owner, and if they are a homeowner, a road accident will be covered on their household insurance. However, with so many dogs found without appropriate name tags or chips, it would be very difficult to determine the owner's identity and therefore virtually impossible to make an injury claim against them.
