Teenage passenger injury and road accident compensation

The category of drivers with the highest incidence of crashes is the youngest, those aged under 25, and often road accident compensation becomes payable to other young people they have been carrying who suffer passenger injury.

It may be unfair to label all young drivers as dangerous, but, unfortunately, inexperience on the part of a driver has a large part to play in many vehicle accidents.

Over-confidence, excess speed, lack of familiarity with the car or unrecognised mechanical defects of it, over-loading either with people or goods, which can affect handling, and inappropriate behaviour by passengers could all unduly influence a driver, leading him or her to be unable to avoid a car crash.

Most young drivers are pleased to be able to take their friends out and about but, despite publicity campaigns about the risks, a number still get behind the wheel when they have drunk alcohol or taken drugs which affects their judgement and increases the risk of an accident.

Their passengers, who are also likely to be teenaged or in their twenties, may also have been drinking and could behave irresponsibly, affecting themselves, the driver or other passengers.

According to the law, a driver is responsible for his own safety, but passengers are in charge of their own. This includes the correct use of seat belts and, although everyone in a car should realise the importance of this protective measure, travellers, particularly back seat passengers, often do not use the belts.

In a sudden impact vehicle accident this can have horrendous consequences with back seat passengers thrown against the front seats or out of the car completely, through the back window, while front seat passengers may be catapulted out of the front windscreen.

After a serious personal injury accident involving young people, it can often be the parents of one or more of the victims who has to deal with the aftermath which may include dealing with the police, medical authorities and a solicitor if there is a question of liability and a compensation claim being made.

Parents always have to act in a legal sense for their children under the age of 18 when there is a damages case or similar but after that age they are adults and would need to bring an action on their own behalf unless they were so incapacitated that a power of attorney had been granted to a family member so that they may officially represent them.

A time limit is set on starting a claim for compensation of three years after the accident but for under-18s, the procedures have to be started before they are 21.
