Greater risk of early death increases need for head injury compensation

Because of the potential long-term consequences of an accident involving the brain, it is important that those who seek head injury compensation should use the services of an experienced PI solicitor with the ability to obtain maximum redress from the person or organisation at fault.

Head injuries can result from a variety of situations such as a car crash or work-related accident and, apart from the most minor surface cuts and bruises, urgent medical attention will be needed to reduce the risk of long-term harm or even death.

The brain is an extremely complex organ controlling every aspect of human existence and any form of illness or injury can have devastating effects for the victim in terms of disability and quality of life.

Although many people who have suffered a head injury can be effectively treated and resume their everyday activities, neuroscientists believe sustaining a head wound – whatever the cause – may shorten the life of the victim by up to ten years compared with their peers, including those who had other health problems.

A study by researchers in Edinburgh and Glasgow universities, published in February 2011, found that nearly 40% of people admitted to hospital with a head wound died in the following 13 years, compared with 19% who had never suffered an injury and 28% with other complaints.

The risk of dying from a head injury within a year of it occurring is known to be relatively high but it seems a trauma to the brain has more far-reaching effects than previously realised.

Head wounds are responsible for the majority of deaths in young people where illness is not a factor and researchers said the long-term fatality rate also seemed to be highest in this age group.

Now that it seems likely a victim of a head injury may not have the expected lifespan of someone who has not suffered in this way, anyone eligible to make a claim for damages, or their dependents, should ensure any settlement negotiated with the party liable for the accident recognises this and sufficient financial safeguards are factored into an agreement.

The courts recognise loss of earnings as an important part of a compensation case as well as pain and suffering generated from a traumatic event. If full weight is not given to the risk of an early death, even if it does not occur as a direct result of the original accident, it will be difficult for the victim's family to return to court after the death and plead for a higher compensation payment.
