Compensation legal advice for parents after a child accident

Children hurt themselves almost every day in some way or another with cuts, bruises and occasional broken bones being a fact of life for parents and often there is no one to blame but the child, however there are instances where compensation legal advice may be needed if another person's actions or neglect have caused the harm.

The most serious accidents are usually those involving a vehicle, including a collision with a car when the child is a pedestrian or cyclist, but there are other situations, perhaps at school or in a public place, such as a swimming pool, where an avoidable personal injury has occurred.

Until the age of 18, a young person cannot seek compensation on their own against the person or organisation deemed liable. An adult, usually a parent or other relative, must act on their behalf as a litigation friend, a responsibility which has to be approved by a civil court.

After that, in most other ways, the claim for damages will then proceed in the same way as for an adult victim but once a case is proved and an amount of money is agreed, the litigation friend will have to attend at court again for the infant settlement approval hearing.

This informal hearing before a judge is intended for him to assess if a sufficient amount of compensation has been awarded and, where possible, the child should attend with a lawyer so that the judge can see how well he or she has recovered from their injuries.

If the amount of money awarded is approved, the judge will make an order to that effect and explain that the compensation will have to be invested until the child becomes an adult at the age of 18 when they can have access to the funds.

Quite often, a judge will decide to give some money to the claimant and parents so that alterations can be made to the family home to accommodate the physical needs of the victim or move to a more convenient property as quickly as possible. Sometimes, part of the settlement will be handed over to pay for a treat for the young accident victim or for practical help with education, such as providing a computer.
