Car crash claim and the dangers of fly-tipping to motorists

Fly-tipping is a real problem in the UK with 2.6 million incidences being reported to Defra every year. Not only is it an eye-sore and a danger to wildlife, fly-tipping can also be hazardous to motorists and could lead to car crash claims.

Fly-tipping is termed as illegally disposed waste that has been discarded in a manner that is likely to cause environmental pollution or harm to human health. In the majority of cases fly-tipping is left on or around the roadside where it becomes a very dangerous hazard for passing motorists.

Waste left in the road not only presents a problem to motorists that might hit it, but also to motorists on the other side of the road that are in danger of getting side-swiped by drivers trying to avoid it. This can lead to serious head on collisions and serious injuries.

Local authorities are responsible for all public land and roads within their boundaries, apart from roads that the Highways Agency is responsible for. Roads are graded on their level of cleanliness, A being the best with no litter, falling to grade D which is given to roads filled with unacceptable amounts of litter.

Grade A levels of cleanliness cannot be maintained constantly but Grade B is normally regarded as acceptable by the public. It is the duty of local authorities and the Highway Agency to ensure that the roads they govern do not fall below grade B.

However, the speed in which the litter is removed is generally reliant on the frequency that the road is used with busier roads obviously receiving more prompt attention than less busy rural roads. Rural roads are also less regularly monitored which can also cause a longer delay in fly-tipping being cleared.

If you have come across fly-tipping in your area, you should report it to your local authority to get it removed. Fly-tipping can be of serious hazard to motorists and can lead to costly car accident claims. Those caught fly-tipping can face heavy fines and even imprisonment depending on the severity of the offence.

If you have been in a car accident that was not your fault, you deserve to claim compensation for any injuries you sustained in the accident.
