Road accidents, youclaim.co.uk

Car accident compensation is not always due from another driver

When a crash between two or more vehicles occurs, often the lack of skill or other failure by one or more of the drivers is at the root of the incident but sometimes neglect or action by another party can be at fault, and it is against them that a car accident compensation claim should be brought.

For example, drivers expect road surfaces to be maintained in a reasonable condition so that they can concentrate on the other vehicles around them, rather than spend time and effort wondering about what is beneath their wheels and whether it will have an effect on their driving behaviour.

Potholes occur naturally through wear on the tarmac, and can be made worse by winter weather, which highway authorities should repair at the earliest possible opportunity otherwise they could be liable for any road traffic accidents caused because a vehicle has lost control.

Motorbike riders and cyclists are particularly vulnerable to surface problems and if they try to avoid a hole, they put themselves in danger of colliding with another car, lorry or other passing vehicle.

Similarly, any obstructions on the road, or at the edge, can present serious risks to two-wheel road users. Road works signs, bollards and debris left in or near the carriageway can be difficult to avoid if they have not been cleared properly.

There have been instances of serious accidents caused by insecure loads on commercial vehicles falling into the path of cars, leading to a crash either into the dropped items or with other vehicles as drivers seek to avoid hitting the material.

Loose parts of roadside structures such as signal gantries, bridges or signs can also cause grave danger to drivers if they drop onto the highway below and those responsible for maintenance of them should be well aware of the need for a strict routine of monitoring and repair.

In country areas, maintenance of fences and hedges is important to keep animals safely away from straying on roads where they could be a major danger to themselves, drivers and passengers of vehicles. Farmers can be prosecuted if their livestock escape because of the poor condition of field boundaries.
