In April 2010, the Ministry of Justice put in place a new system aimed at streamlining the car accident compensation claim process to help cut the time legal cases take to settle.
The system was focused on those making claims between £1,000 and £10,000 which covers around 80% of all road traffic accident personal injury claimants.
The measures concentrated on reducing claim times, introducing fixed legal costs, a time limit on insurers deciding liability and the use of a generic electronic claims form.
Previously, delays could leave the claimant facing several weeks' or even months' wait as defendant insurers/representatives investigated the accident and determined liability. However, under the measures introduced in April 2010, the defendant insurer/representative now has a maximum of 15 days from the date of notification of a claim to respond with a decision on liability.
Once liability has been established, the parties are encouraged to obtain expert medical evidence that substantiates the injuries suffered in the car accident along with other supporting documentation as the claim is investigated. As with the determination of liability, under the updated measures, there is now a maximum period of 35 days for this investigation to be carried out. If negotiations do not result in settlement within this time period, the matter will be decided by the court.
It is hoped that the updated claims process will help provide a quicker resolution for claimants; resulting in injured parties gaining their compensation in a fraction of the time of the preceding process.
However, while the measures will help improve the time between the making of a claim and receiving compensation for most claimants, each case will be dealt with on an individual basis meaning that some cases may take longer than others.
