Uninsured drivers are a menace in car accident personal injury cases

Following a hit-and-run car accident the likelihood of obtaining compensation for personal injury is slim, but it can be done through the Motor Insurers Bureau (MIB).

In 2009, following a claim from a Sale cleaner on behalf of her daughter who was severely injured in a car accident in 2004, calls for better ways of catching uninsured drivers were aired by members of the public.

The Sale woman's daughter was awarded a £1million lump sum and an annual payment of £40,000 from the MIB fund after the owner of the Daimler that hit her came forward as owner of the car but denied driving it at the time of the accident. As a consequence the only charge that could be brought against him was one of driving without valid insurance.

He was fined £200 and banned for 12 months, but with no insurer to pay out for driver's liability in the accident, the young woman was left without immediate redress.

The car accident victim's family took their case to the High Court and after a five-year battle the compensation award was granted.

The solicitor for the family, said, "While it will never be possible to fully compensate Katrina for her injuries, I hope this settlement enables her to live as independently as possible in the future."

Public comment on the perpetrators of non-insured car accidents
As reports of the award appeared in the press and online, members of the public made calls for new measures to catch drivers of non-insured vehicles and those who deny driving a vehicle that has been involved in a road traffic accident.

One measure suggested, was to build a driver fingerprint database, whereby police at the scene of an accident could take prints from the car to see who was likely to have been driving the car at the time of the accident.

Another idea put forward was on similar lines to the new rules regarding seizure of un-taxed cars, whereby if police Automatic Number Plate Recognition (ANPR) cameras pick up a car without up to date road tax, they have the power to seize and dispose of the vehicle, usually by crushing.

The respondent suggested that police equipment should be able to pick up vehicles that do not have an insurance policy attached to them and this could alert officers to an uninsured driver, they should then have powers to pull that driver over and seize the vehicle.
