New mobile ban could see decline in car accident compensation claims
YouClaim receive calls and emails from customers who wish to make car accident compensation claims following non-fault road accidents that occur in a variety of circumstances. However, the introduction of the tougher mobile phone penalty could see a welcome decline in car accident injuries on British roads that are caused by the type of careless driver that likes to chat.
In December 2003 a law was introduced pertaining that motorists caught making calls or texts would receive a 30 fine to prevent the use of hand-held mobile phones behind the wheel which made punitive provision of a £30 fine for motorist who are caught phoning while driving.
Ninety two percent of people were reported to have supported the move yet 21% of drivers admitted to breaking the law after it was introduced. Despite the fact almost 74,000 fixed-penalty notices were issued in England and Wales during 2004, it is believed that a staggering 6.7 million people use mobiles while driving, leading the government to decide that further action needs to be taken in order to decrease car accidents and the onset of subsequent compensation claims.
Owing to the introduction of the new mobile phone penalty, from the 27th February 2007 drivers caught using hand-held phones while driving will automatically receive 3 points to their licence and a maximum on-the-spot fine of 60. This fine could rise to 1,000 for car drivers or 2,500 for van, lorry or bus drivers if they contest their charge and fight it out in court.
The main reason for the introduction of this more stringent penalty is that drivers are not considering the impact that mobile phone use while driving could have. It is quite simply impossible for drivers to do more than one thing at a time. Driving takes a lot of concentration, involves operation of the vehicle as well as looking out for road signs and staying aware and alert of other drivers, meaning that any other activity carried out while driving distracts s drivers attention away from the job in hand.
Motorists may argue that it takes just a few seconds to write and send a text but it takes less than one second to take your eyes off the road and cause a vehicle accident that could cause serious personal injury to other motorists, passengers and pedestrians and end up in numerous costly car compensation claims having to be made.
When asked, even the most fervent ‘phone and drive’ motorists agree that they’d rather not suffer the inconvenience of having a no win, no fee solicitors claim made against them than desperately cling to their right to ‘phone and drive’.
