In August 2004, the nine-month-old baby fell from a changing table, sustaining serious brain damage. A delay in diagnosis by NHS doctors also compounded his brain injury problems.
He was left quadriplegic and unable to swallow properly. He also required a gastrostomy tube for feeding, ventilation at night and tracheostomy support.
Medical experts believed he would not live past 15 years of age.
The nursery and NHS trust responsible for his immediate care after the accident both admitted liability and in a 2008 civil litigation compensation claim the family were awarded an interim payment of £320,000 to add to the £1 million they had already received for suitable accommodation and to pay for care of the little boy.
In December 2009, a final, undisclosed sum was agreed for the ongoing care of the boy.
A lawyer for the HNS trust said, "We hope that for the future one great worry has been removed and that James's financial well-being will be well provided for."
The presiding judge commented, "The experience of approving settlements in cases like this is a very humbling one.
"As a parent myself, I can only admire the resilience, the fortitude and the unstinting devotion of Mr and Mrs Pitcher, and their child - this young boy - for what remains of his life, will continue to benefit from that."
