Getting an apology for your car accident

People involved in car accidents that were not their fault, whether or not they have suffered personal injury, are often as keen to receive an apology as a payment of damages.

For this reason, it can sometimes be galling that insurance companies regularly advise their clients not to apologise if they are involved in car crashes, no matter how obviously the fault may lie with them. The reasoning for this is that an apology may be taken as liability, and admitting liability for the personal injury or the damage to a car pre-empts the decision that the police and insurance company are supposed to come to.

However annoying the lack of an apology may be at this stage, knowing why it is absent may help to let that annoyance go temporarily. In some cases, the apology that could not be given before the liability issue was settled by the insurance firm and the police may arrive once those details are established; in others, an apology may come at the conclusion of a compensation claim. And sometimes there may be no apology at all.

Before an apology is given, someone who has been injured in a road traffic accident may be tempted to bring a no win no fee compensation claim as a kind of 'revenge'; this is unlikely to be a wise move, as any decision relating to a claim should be based on a firm understanding of the situation and the personal injury law that relates to it rather than a sense of outrage.

Whilst it is in no-one's interests to begin an unwinnable claim, whether there has been an apology or not, a good personal injury lawyer will be able to help a car crash survivor decide where his or her case stands within that law, and whether proceeding with that claim would be a good idea.
