Although they are very busy, the major roads of the UK are some of the safest in terms of people killed or seriously injured, and having to make a motorway accident claim is relatively unusual.
However, should the worst happen and a road traffic accident occurs when you are in the middle of a long journey there can be points you may not have thought of which are less likely to be a problem in a more urban setting.
With the volume and speed of traffic on most motorways, when a car crash happens, a queue will quickly build up behind the incident as other drivers either stop to help or wait for emergency services to arrive and, usually, the police, ambulance and fire service are quick to respond, helping casualties and clearing the road.
If you are a driver who is a victim of a vehicle accident or have someone who has suffered a passenger injury, quite rightly, you will be extremely preoccupied with the health and safety of all the people involved and preventing any other accidents from following traffic, but once anyone who is hurt has been tended and damaged vehicles moved to the hard shoulder, it may be time to think how the accident happened.
With all vehicles moving in the same direction and junctions carefully controlled, collisions mostly occur through driver misjudgements during overtaking manoeuvres or shunts from a following vehicle being unable to stop quickly enough when the one in front slows.
Debris on the road surface, some flying object or difficulties caused by road works could also be the cause of a crash.
Deciding responsibility for an accident is up to the police when compiling an official report and this will be used to decide civil liability too if a compensation claim is to be made by one or more of the parties involved. Sometimes, however, with the speed of traffic and other circumstances it can be difficult to know where fault lies.
Closed circuit cameras keep a watch on many motorways and monitoring staff often call emergency services when they see an accident or potential problem occur. The films from these can then be used as evidence in a subsequent court case should a particular driver be found to have caused a crash.
However, there can be times when the camera is obscured or does not cover the particular part of the road, then it will be up to a claimant to try to establish what happened before he can prove someone else's negligence or actions led to their personal injury.
A lack of witnesses could well hinder a satisfactory outcome because they could have travelled out of the area or be unaware of an accident behind them. On a busy road such as a motorway, nobody wants to stop for long or become involved in the aftermath of an accident unless they really are obliged to do so.
As with any traffic accident where there has been personal injury or damage to property, it is best to get names, addresses and references of everyone involved and then take legal advice as soon as possible to be prepared for claims.
