Asbestosis compensation and the importance of building surveys

Although now a banned substance in construction, asbestos used to be a popular material used mainly for insulating roofs. Once it was discovered that an inhalation of asbestos fibres can lead to diseases such as mesothelioma and asbestosis, compensation was sought by sufferers and the material was banned.

In June 2010, a house developer was fined by the Health and Safety Executive (HSE) for asbestos-related offences after they failed to conduct a survey on an area to be demolished.

The housing company demolished Cellar Cover Hotel at Droskyn Point in Perranporth in July 2006 to make way for guesthouses and holiday apartments. An investigation by the HSE discovered asbestos-containing insulation boards under a caravan, in polythene sacks and in bonfire ashes around the site.

The HSE also noted that the Cornwall-based company had failed to provide safety signs to protect its workers from asbestos fibres and found the company guilty of breaching regulation 15 of the Control of Asbestos at Work Regulations 2002, fined them £4,500, and ordered them to pay £11,959 in costs.

Speaking on the case, an HSE spokesperson said, "This incident was entirely preventable and the clean-up costs far outstripped the costs of a survey and safe removal of the asbestos material."

Developers have a responsibility to ensure a safe working environment for their workers. The effects of asbestos dust can take up to ten years to show so it could be a whole decade before workers at the Perranporth site know if they are clear of asbestos-related diseases.
