Many sufferers of asbestos-related illness are able to achieve some degree of redress for their condition by pursuing a claim for 100% compensation from their employer through the civil courts. Of course, a personal injury damages award will never replace good health, but for many, especially those with terminal asbestos illnesses such as mesothelioma, knowing that loved ones are financially secure after their death is a great comfort.
Yet, some victims of asbestos exposure also take solace in campaigning for personal injury victims' rights and one such activist was Bernard Dean, a former council employed joiner, who was diagnosed with mesothelioma in February 2009.
Mr Dean successfully sued his former employer for asbestos compensation and received £220,000 damages for their part in his illness.
However, despite his debilitating asbestos-related illness the former council house renovator went on to campaign on behalf of those workers who were unable to make a claim.
In December 2009, Mr Dean spoke with the then Prime Minister, Gordon Brown, about the instigation of a fund for workers who had suffered because they had been negligently exposed to asbestos, but could not mount a claim against their employers because the firm had gone out of business.
Calls have been made for a database of liability insurers to be set up, so that if a company ceases to trade, the insurers who took premiums for liability insurance can be pursued with a view to the payment of compensation to sick and injured workers.
Mr Dean went another step in the cause of helping asbestos exposure victims and took part in a drugs trial which had the potential to help him and other mesothelioma patients overcome the fatal disease.
At the beginning of 2010, Mr Dean was the first mesothelioma patient in the world to take LDE225, a cancer drug, in the hope that it would prove effective against the spread of the disease.
Unfortunately, during the treatment his health deteriorated and he was forced to halt participation in the trial.
Bernard Dean finally succumbed to mesothelioma in August 2010. His wife paid an emotional tribute to him.
"He was always thinking of somebody else," she said.
"He'd put himself through treatment just to help others with the disease.
"It was brave of him to do that drug trial. He was devastated when he was told that he couldn't carry on."
