Pleural plaques asbestos claim success story
In July 2004 we received a call from a Norfolk man who wanted to make an asbestos claim after he was diagnosed with pleural plaques just six weeks earlier.
The man, who worked as a window fitter throughout the 1980s found out by chance that he had developed pleural plaques after being involved in a car accident. He sustained damage to his chest when his car, which didn't have a frontal airbag, was involved in a collision. When taken to hospital he complained of chest pains and he was given an X-ray to check for internal damage. The X-ray revealed that he had pleural plaques.
After telling him that pleural plaques are basically fibrosis found on the inner surface of the ribcage and diaphragm, the doctor asked the man whether he could have been exposed to asbestos in the last 10-20 years. He replied that he had fitted windows in houses that were insulated with the dangerous fibres and the cause of the pleural plaques became clear.
The doctor told him that unlike mesothelioma, pleural plaques is a benign pleural disease. He also informed him that plaques are chronic and have no cure but unlike pleural thickening, should not cause him any breathing difficulties. However, he was warned that he should take good care of his health as he may be at an increased risk of developing other asbestos-related diseases.
This news brought with it mixed emotions for the ex-window fitter. He was relieved at not having developed a fatal illness like mesothelioma as a result of being exposed to asbestos all those years ago but also anxious about the possibility that he might contract a more serious disease. His doctor gave him some leaflets about the condition and he read that some people had made successful industrial disease compensation claims for pleural plaques. He decided that this was what he wanted to do and decided to pursue a claim through us.
When we received his call we explained that we work on a no win, no fee basis and that it wouldn't cost him a single thing to make a claim through us. We then put him in touch with a compensation solicitor who talked him through the claims process, plainly and clearly. He decided to go ahead and made an asbestos claim against his employers for the distress that the pleural plaques had caused him and was awarded £16,208.
