The 1,673-acre site of the abandoned mine was one of several contaminated areas covered by the settlement – the deal included $7.75 million to secure the site, up to $26 million for clean-up operations and $850,000 to offset environmental damage.
The settlement came after federal complaints were filed in New Jersey alleging several health and environment concerns regarding the Vermont Asbestos Group Mine Site (VAG Site).
Justice officials ruled that two large piles of tailings (processing residue left after mining) were believed to be eroding into downstream creeks and wetlands. It was also noted that the piles attracted hikers, rock collectors and owners of All Terrain Vehicles who could be unknowingly exposing themselves to airborne asbestos particles and stirring up fibres that would further contaminate the surrounding area.
Exposure to, and inhalation of, these fibres can lead to serious asbestos-related respiratory diseases and mesothelioma. The settlement agreement aimed to contain the site with the construction of fencing, gates and road barriers to restrict public access to the site. The mill buildings were to be secured and onsite surveillance set up to prevent further disturbance of the disused asbestos mine.
The company was also required to monitor air emissions from the site and conduct dust suppression if found to be necessary. A proportion of the monetary figure was to be used to settle federal claims for environmental damage and clean up costs at other VAG Sites.
