An October 2007 House of Lords ruling decided that workers who have developed pleural plaques as a result of exposure to asbestos are not entitled to asbestos compensation.
The reasoning behind this ruling is that the medical fraternity believes pleural plaques to be a "benign disease". This means that, while pleural plaques do affect the lungs, they do not in the majority of cases cause any debilitating symptoms such as reduced lung capacity or breathing difficulties.
Despite this, many people afflicted with pleural plaques claim that the anxiety of having the disease should entitle them to asbestos compensation.
There is some value in this argument. People with pleural plaques do have a higher than average chance of developing other asbestos-related diseases such as mesothelioma and asbestosis.
Yet while those with pleural plaques have a higher chance of developing these asbestos-related diseases than members of the population who have not been exposed to asbestos in the workplace, their chances of developing these diseases is equal to that of asbestos-exposed workers without pleural plaques.
Since there is little or no causal or predictive relationship between pleural plaques and the development of asbestos-related cancers, the House of Lords made their controversial decision that sufferers of the condition cannot claim asbestos compensation.
