At the time of writing it is possible to make an asbestos compensation claim in the UK for the diseases mesothelioma and asbestosis; however, it is not possible for damages to be received for the condition known as pleural plaques.
This anomaly is attributable to a decision by the Law Lords to list it as a non-compensable condition, a decision based, in a large part, on the findings of report entitled Medical Aspects of Pleural Plaques.
Medical Aspects of Pleural Plaques was written by Professor Robert Maynard, a leading expert in air pollution; however, it has since emerged he fulfils few of the necessary criteria to allow him to be considered an expert in pleural plaques, a fact which has led to outcry among pleural plaques sufferers, union officials and industrial disease solicitors.
Indeed, according to one union, Prof Maynard even "admitted to experts in asbestos diseases that he had not met any patients with asbestos diseases."
These revelations have led to Alan Ritchie, UCATT general secretary, to comment, "It is outrageous that the person tasked with writing such an influential report was not an expert in this field and had never met a pleural plaques victim.
"This dossier is at best dubious. I hope that it will no longer be cited as a reason why pleural plaques victims should not receive compensation for their injuries."
While a spokeswoman from the Bradford Asbestos Victim Support Group, an organization that among other things offers support during the process of an asbestos compensation claim, said that Maynard's involvement was "indefensible" and said that "only a bumbling fool would not see that pleural plaques has a massive negative impact on health".
