Asbestos compensation solicitors require tenacity

In 2009 a report in the Manchester evening news told of one woman's seven-year fight to win the compensation her late husband had been posthumously awarded after he had succumbed to mesothelioma in 2001.

The man, from Ashton under Lyne in Lancashire, had worked for a firm of dismantling engineers in the 1960s where he was exposed to asbestos fibres during the demolition and stripping of buildings and equipment.

His asbestos compensation case was settled for £60,000 in 2005, but in 2003, crucially after the claim had been lodged, the firm was wound up and ceased trading. Despite having assets at the time of over £250,000 no money was put aside to pay compensation to the worker's widow.

In a cruel twist of fate the insurers had also ceased trading and so, the widow's solicitor tried to claim from the Financial Services Compensation Scheme, but they would not meet the damages award as the case had been commenced before the company was wound up.

Eventually the widow's solicitor pursued the former directors of the firm and they were ordered to pay the asbestos compensation from their own pockets.
