Many asbestos compensation cases arise after employees who were not protected from the lethal effects of the deadly fibres contract mesothelioma as a result. However, if your asbestosis can be traced back to illegal disposal of the material, the firm responsible may still be held liable.
In April 2009, a woman from Barrow-in Furness, Cumbria found her children playing with dumped asbestos sheeting after men were seen unloading the corrugated roofing material from a van. When quizzed about the asbestos sheeting, the workers replied that they were using it as "crab mats" along the Walney Channel.
A local environmental officer for Barrow Borough Council said at the time, "There is still a lot of asbestos cement material in use in the community providing facilities like rainwater gutters and pipes, so it isn't illegal to have this material in your possession.
"The potential hazard arises from how you handle it. My advice to the chaps using it as crab mats would be not to use it for this purpose as the material is potentially hazardous."
Asbestos disposal
Under the Control of Asbestos Regulations 2006 companies involved in working with asbestos insulation, asbestos coating or asbestos insulating board will need to hold a licence from the Health and Safety Executive (HSE).
Non-licensable asbestos materials can be removed from sites by homeowners or non-licensed tradesmen, but they must be disposed of as hazardous waste. Asbestos sheeting should be removed whole and should not be broken up. Loose or small pieces of asbestos containing materials should be placed in labeled bags and sealed. They should not be included with household rubbish.
Local councils will hold a list of sites that dispose of asbestos materials and companies who are licensed to work with and remove asbestos.
Illegal disposal of asbestos
If a company or its employees are dumping asbestos materials on public ground, they are breaking the law and could be prosecuted. If you have information about the illegal disposal of hazardous materials, you should contact your local authority immediately.
If you have been exposed to asbestos fibres as a result of the illegal disposal of hazardous materials and you have contracted an asbestos-related disease, you may be able to claim asbestos compensation with YouClaim.
