Total cost of asbestos compensation for pleural plaques up for debate

The issue of whether or not to pay asbestos compensation to sufferers of the condition pleural plaques is one that will just not go away for UK governments. Although the House of Lords voted that the condition was "benign" and therefore not worthy of compensation, Scottish Parliament received widespread praise from both asbestos campaigners and personal injury lawyers for its decision to reverse the ruling.

In late 2008 however, only a few months after making their decision, even the Scottish government was again forced to debate the issue.

And it is not only differences south of the border that continued to inflame contention. Foremost among the concerns of some figures in parliament is conflict over the estimated total cost of asbestos compensation payouts for the condition. Variance in methods for calculating estimates has seen figures range from as much as £607 million to as little as £67 million. As a result, the Coservatives have called for Parliament to mount a full investigation into the potential costs of pleural plaques settlements.

However, there remains a strong feeling that insurance industry fears about being hit with a high number of claims are behind the debate. For example, while the Health and Safety Executive has stated confidently that 10% of all cases of asbestos UK exposure occurred in Scotland, the Association of British Insurers has sought to maintain the figure is closer to 30%.

Scottish community safety minister Ewing Ferguson responded to the concerns, "We aim to analyse any new information carefully and report the results to Parliament in good time," he said.

Adding, "Of course, employers and insurers have registered concern about the costs that they may incur and the implications for our economic competitiveness. "We understand that concern, but we believe it is exaggerated - seriously exaggerated."
