Why some people cannot make an asbestos claim

In the vast majority of cases of mesothelioma, the person affected will be able to at least proceed with an asbestos claim for compensation.

However, for a minority of people suffering from the cancer there will be no history of exposure to any form of asbestos, whether the brown or blue amphibole forms or the white crysotile form.

This will mean that despite tracing the person's home, educational and work history, a no win, no fee solicitor will be unable to find any evidence of even minimal exposure to the harmful substance.

Although this scenario does not necessarily mean that the person has never suffered any exposure to asbestos – the statistical likelihood is that they have – it does mean that, unless evidence of exposure can be found, he or she will be unable to proceed with litigation.

In fact, it is only a tiny fraction of people who develop mesothelioma without exposure to asbestos being the cause of the cancer. Official estimates put the figure of non-asbestos related mesothelioma at around 1% of all cases.

Indeed, Dr Rudd, one of the UK's leading mesothelioma experts, told the High Court in a high profile 2009 asbestos claim, "Mesothelioma is a rare tumour in people who have not been exposed to asbestos, occurring with an annual incidence of around one per million of the population."
