Industrial illness claims for indoor air pollution in all workplaces

Workplace dust and pollution, if not properly managed, can give rise to an industrial illness claim in even the most benign seeming of workplaces.

The Health and Safety Executive requires all employers to provide "Effective and suitable provision to ensure that every enclosed workspace is ventilated by a sufficient quantity of fresh or purified air".

Where this does not happen, workers may suffer the effects of dust and air pollution caused by furnishings, fixtures, construction materials, equipment, wood dust or contaminants such as solvent or glutaraldehyde fumes, ozone or oil mist.

Where proper precautions have not been taken, workers may develop a range of conditions, such as asthma or dermatitis.

It is even possible that more serious conditions may develop such as Multiple Chemical Sensitivity, which, through the effects of cumulative exposure, can cause people to suffer severe reactions to harmful substances even at very low doses.

Even more seriously, fumes and dusts from certain chemicals can cause exposed workers to suffer a range of central nervous system disorders or cancers.

Employers can help avoid these conditions and consequent liability for industrial illness claims by taking a range of precautions. From ensuring adequate ventilation and cleaning to monitoring worker health and taking workplace air samples, employers can take meaningful steps to reduce the risk of workers becoming ill as a result of indoor air pollution.
