Responsibilities of the MIIB in examining accidents at work
When a major accident at work occurs such as the Buncefield oil storage tank explosions of December 11th 2005 the Major Incident Investigation Board (MIIB) will carry out full enquiry on and reporting of the events leading up to, during, and consequences of the incident.
Responsibilities
The MIIB is responsible for:
- receiving and monitoring regular reports from the team leader of the investigation
- ensuring the identification of the immediate and underlying cause of the incident and to determine whether the duty holder (e.g. owner of site) was compliant with relevant law
- overseeing the collection of evidence and that all conclusions drawn from evidence will withstand scrutiny
- determining, in liaison with the Legal Advisor’s Office, whether interim technical reports should be published if industry health and safety implications emerge
- agreeing any action to be taken by the Health and Safety Executive (HSE) (although board members, independent of HSE are not involved in considering enforcement actions)
- endorsement of the report at the conclusion of the investigation
The MIIB also:
- ensures that HSE’s policy and procedure review team are made aware of and examine any relevant issues of the investigation, and that suitable recommendations are made
- monitor the policy procedure and review process by examining regular reports from the review team leader; steering the review as necessary, and approving the eventual policy and procedure review
Also, Board Members independent of HSE are particularly required to:
- provide an independent analysis of the interpretation of gathered evidence and the conclusions made
- provide assurance to the Executive that major incident investigation, policy and procedure review processes meet their terms of reference
- ensure the performance of duty holders has been thoroughly examined, the causes of the accident at work have been identified and remedial actions have been taken or proposed
- ensure the policy and procedure review investigation have been properly carried out and the role of the HSE, and where relevant the role of the Health and Safety Commission, before the incident occurred has been properly examined
