In 2010, a young Muslim mum died when her hijab became tangled in the wheels of a go-kart and strangled her. The 26 -year-old woman was on holiday with her husband and two sons, aged six and four when the tragic accident happened.
Witnesses to the accident said that her clothing was "wrapped around her neck" during the incident in Port Stephens, Australia. Part of her hijab was pulled across her throat, with the longer part wedged near one of the go-kart's axles.
Authorities immediately closed the track following the accident and it remained closed following the discovery that it was unregistered.
Before allowing the women on the course, track officials should have ensured that the women's clothing was secure and would not pose a risk to her safety. Staff at activity centres have a duty to ensure the safety of their customers and ensure that all risks are kept to a minimum. Customers that are not wearing suitable clothing and are unwilling to change into more appropriate attire should be banned from carrying out the activity for their own safety.
Relatives of the women may be able to make a compensation claim for the women's death if the go-kart company is found to be negligent for not ensuring their customers' safety.
