In June 2010, the Crown Prosecution Service (CPS) decided that following an investigation into the tram accident by the Rail Accident Investigation Branch (RAIB) there was enough evidence to charge the tram driver with causing death by driving without due care and attention.
The CPS said it was in the public interest to prosecute the driver for the woman's death.
A CPS spokesperson said, "Summonses have been obtained from Blackpool Magistrates' Court and will now be served on [the driver].
"[The holiday accident victim's] family have been informed of the CPS decision."
If the prosecution is successful and the driver is found guilty of causing the holiday maker's death, it may be possible for the family of the victim to make a compensation claim against his insurers, if they so wish.
