Animal attack and accident at work compensation claim litigation in the US

However the owners alleged the accident occurred as part of the personal injury victim's employment and that the claim should fall under the provisions of the state workers' compensation laws.

Under those laws, the damages awarded would be payable by the Tow Truck company's insurers. The victim would have her medical bills paid and would receive partial payment for loss of earnings, she would not however receive any payment for pain and suffering. Typically, workers' compensation in the US recompenses around 65 - 75 percent of wages.

Workers' compensation experts commented that lawyers for the chimp's owner would have to prove the employee's injuries were work-related and that, at the time of the accident, the personal injury victim had been engaged in an employee-employer scenario in order for workers' compensation law to apply rather than a full civil case.
