In June 2009, sentencing for directors found culpable in the death of employees involved in accidents at work came under the spotlight when two cases regarding fatalities came to court.
On 8th June, two directors of a Scottish construction company were convicted after a trial regarding the death of a worker who fell down an exhaust shaft in a block of flats under construction. And on the same day a man was sentenced after causing unnecessary cruelty to a rabbit, after having killed it by stamping on it.
The perpetrator of animal cruelty received a six-month prison sentence.
The first construction company director – found guilty of breaching Section 2 (1) of the Health and Safety at Work Act 1974 – was fined £5,000. The second director, who was site manager at the construction project, was fined £4,000 after being convicted of breaching Section 37 (1) of the Health and Safety at Work Act 1974.
Campaigners from FACK – Families Against Corporate Killers – were outraged at the disparity of the sentences and the reflection on the legal value of human life when compared with that of an animal.
As part of their mission statement FACK says they are seeking urgent government action to halt the complacency about deaths at work and want the introduction of laws that are able to bring negligent bosses to full justice.
They also call for a review of the way fatal accident at work are investigated and how bereaved families are treated. FACK wants workers and safety representatives to be given greater rights to protect themselves from exposure to unnecessary and unacceptable risks to their lives and health.
