In the past, it was quite common for non-integrated "cages" or platforms to be used on forklifts. These non-integrated cages allowed workers to stand on the forklift and perform occupational tasks, but without any level of control over the cage. However, after many a forklift truck accident and injury compensation claim involving these cages, it became clear that they posed a considerable safety hazard and their use in the UK has now been banned.
However, there are a few exceptions to this ban, but they are just this, namely, "exceptional".
This definition of exceptional includes emergency events where there is no other option but to use a non-integrated cage. An example of such a situation might be where a light bulb has expired in an essential working area and needs changing. More details about exceptions can be found at the appropriate HSE location HSE Guidance Note PM28.
Indeed, in addition to their extremely hazardous nature, non-integrated cages have become a thing of the past because of the advent of better and safer, purpose-built equipment, commonly called Mobile Elevating Working Platforms (MEWPs).
MEWPs are superior to their non-integrated antecedents largely because of their fully integrated controls, which allow "caged" workers a level of control over their destiny.
YouClaim's factory and construction site accident claim specialist spokesperson says that employers should always avoid using non-integrated cages. "Despite the exceptions, there really should be no excuse for using a non-integrated cage.
"Experience amply demonstrates that they are just too dangerous. As a no win, no fee solicitor who specialises in this area of the litigation, few things are as depressing as hearing that workers have sustained injury as a result of an employer's or site manager's failure to comply with the law."
