Legal Aid - Funding your personal injury compensation claim
Until fairly recently, Legal Aid was available to people who wanted to make a claim for personal injury compensation. If you had been injured in an accident caused by someone else's negligence, you could appoint a solicitor to help you make a claim and they could apply for Legal Aid on your behalf, to cover their legal fees.
The Government funded scheme was withdrawn in 1998 for the majority of personal injury cases (the main exception being medical negligence claims) as it was becoming an increasing burden on the public purse. The financial risk associated with compensation claims was passed on to the legal profession.
No win no fee
No win no fee (or conditional fee agreements) are now the basis upon which the majority of personal injury compensation claims in the UK are undertaken. Under these schemes, solicitors only get paid their fees if you win your claim, and then they are paid by your opponent's insurance company.
No win no fee schemes vary from company to company and they only cover your legal fees, not your opponents, which you are liable for if you lose your claim.
