Make a claim for compensation following a slip, trip or fall accident
Slip, trip and fall accidents can happen almost anywhere. People regularly suffer injuries on uneven pavements, defects in the road, icy pavements and broken steps and, while the list is almost endless, slips, trips and falls most commonly occur as work accidents.
Claiming compensation following a slip, trip or fall
Successful compensation claims following slips, trips and falls can be made in many different circumstances. These types of accidents can generally be grouped as follows:
- Accidents at work - your employer has a legal duty to care for your health and safety whilst at work.
- Accidents on roads and pavements - your local council has a legal duty to maintain the roads and pavements to a reasonable standard.
- Accidents in shops - shopkeepers have a legal duty to ensure the safety of their customers whilst they are on their premises, including the car park.
- Accidents in other places - places that are accessible to the public are also covered by laws to protect people from injury.
The most seemingly insignificant thing can often cause a very serious personal injury. A wet floor in a supermarket, broken chair in a restaurant or badly lit stairs in a car park, could all lead to successful compensation claims.
If your slip, trip or fall was caused by a defect that shouldn't have been present, then you are entitled to make a clam for compensation if you suffered a personal injury as a result.
What to do following a slip, trip or fall
It is easy to feel foolish if you have fallen over, even if you did so as a result of someone else's negligence. Our natural instincts tell us to move away from the scene of the accident as soon as possible, especially if treatment for injuries is needed.
There are however a number of practical things you can do at the accident scene, which will help any potential claim you may later make. If you are unable to do so at the time, return as soon as you can or ask a friend if they can do the following:
- Photograph the scene of the accident and anything else that may be significant. For example, the floor surface and any defective coverings or holes, the clothing and shoes you were wearing and any visible warning signs relating to the defect. Also, take pictures of your injuries if they are visible and take further pictures if they worsen.
- Write down the names and contact details of witnesses who saw the
accident happen or saw the defect
- Write down the names and contact details of anyone else you know that
had previously been, or was subsequently; injured by the same defect
- If the accident happened at work or in a public place, make sure you
report it to a manager and ensure they write it in their accident book
- Keep the shoes that you were wearing
