Vibration white finger the need for the LCS to seek assurance from solicitors
If you are a miner seeking to claim compensation for vibration white finger, it is unlikely that you will want any part of the damages award you receive to line the pockets of the solicitor that represented you.
Here at YouClaim, we are proud to offer all our clients a guarantee that we will never help ourselves to any fraction of their award - meaning all who claim with us receive 100 percent compensation.
However, there are still a number of firms and claims-handlers, who despite concerns expressed by both the Legal Complaints Service and the Solicitors Regulation Authority, seek to take a cut of miners’ awards for themselves.
Despite such concerns being both long-running and well-documented, the Legal Complaints Service took unprecedented action in 2008 by asking 817 firms to confirm that they have never, nor will ever, take cuts from the VWF payouts of miners. Those firms which do not reply to the letter will have their clients contacted and advised that it is possible to lodge an official complaint.
What is clear is that the Legal Complaints Service was merely taking pre-emptive action with a view to ensuring that no miners are unfairly treated by the firms who are meant to be acting in their best interest.
However, some firms struggled to see it that way, claiming that the Legal Complaints Services is acting both cynically and outside its remit.
One Liverpool-based personal injury solicitor commented, “It suggests either currently, or in the future, firms are likely to engage in, at the very least, unprofessional behaviour and at the very worst, in underhanded behaviour. It’s a threatening letter.”
Yet, if wholesale pledges not to take cuts from VWF awards mean that the claimant is protected, it surely cannot matter that a few sensitive solicitor firms feel that aspersions are being cast on their integrity. After all, civil compensation processes are their to benefit the indivdual, not to pander to the moral insecurities of certain legal firms.

Vibration white finger can be a distressing and debilitating condition. If you have developed it as a result of exposure to excessive vibration in the workplace, you may be able to claim compensation.
The autumn and winter months are particularly difficult for anyone with the vibration white finger. Cold and stress may trigger an increase in both the intensity and frequency of attacks, making it difficult for some to perform even the simplest tasks, such as getting dressed, driving, typing and writing.
The condition may also interfere with a person’s ability to work unhindered.
If you suffer from any of the above, you may benefit from the expertise of our personal injury solicitors.
All are governed by the Solicitors Regulation Authority, and all work on a cost free basis - win or lose. This cost free philosophy extends to the final settlement, as we never take any cuts, ensuring all successful claimants (as most of ours are) receive 100% compensation.
