Successful compensation claim for road worker with VWF
In November 2006 we received a phone call from a 39-year-old ex-road worker who wanted to pursue a claim for personal injury compensation after developing Vibration White Finger (VWF) as a result of his job.
He told us how, at the time he sustained his industrial illness, he was working in a team who completed highway maintenance for Hampshire County Council on a regular basis.
His job involved regular use of a pneumatic drill to break up concrete roads so that potholes could be filled and fresh tarmac laid down. Sometimes he would use a pneumatic drill for much of the day and he was never offered the use of anti-vibration gloves or warned of the effects of VWF.
Around three months into his job he noticed how his fingers would feel tingly, numb and turn a patchy white after a day's work. In addition, he suffered a pins and needles sensation to his fingers, hands, wrists and arms.
After another two to three weeks he noticed that his fingers seemed to get colder and colder throughout the day when using the vibrating tool. The discomfort got so extreme that he began to have trouble sleeping at night. This made him crabby, even more intolerant to the pain and increasingly difficult for him to make it through a full working day. At this point he realised that he needed a medical opinion.
His wife made him an appointment at the doctor's surgery and the doctor's immediate suspicions were that the road worker had developed VWF. Following a set of tests, these suspicions were confirmed and the Hampshire man was diagnosed with the constrictive blood vessel disorder.
The doctor signed the road worker off sick and gave him some information about the industrial illness, including some information on making an accident at work compensation claim.
In due course, the 39-year-old contacted us and on agreeing to take on his claim we put him in touch with one of the personal injury solicitors from our expert panel. They talked him through each stage of the case without using complex legal jargon and helped him to win 100% compensation on a no win, no fee basis.
Within a few weeks he received a cheque for £14,600 in compensation for the pain and suffering as well as the loss of earnings that his VWF complaint had caused.
