Mining organisations continue to complain about industrial negligence
Miners in the UK are calling out for better industrial accident health and safety prevention measures and a former minister has attacked the Department of Trade and Industry (DTI) for failing to compensate sick workers and their families.
The mining industry had been campaigning for compensation for over a decade and since 1999 more than 3 billion pounds have been paid to miners for conditions ranging from Vibration White Finger to bronchitis and emphysema.
Insufficient compensation is being awarded and some miners are left out
The figure sounds commendable but there are still fault lines in the compensation payout scheme. Surface workers are excluded from compensation payouts, despite the fact that the DTI has already accepted liability to compensate them.
Miners and mining organisations have rightly pointed out that excluding workers with the same illnesses who had only worked on the surface is very strange. They want complete inclusion of all miners working in all areas of the industry suffering from Vibration White Finger as well as other industrial illnesses.
So far, the DTI has made over 500,000 compensation payments to former miners and their families, for respiratory diseases such as emphysema and vibration-related injuries. Personal injury solicitors handling the claims have been paid £728 million for their work.
The legal services ombudsman ruled in April 2006 that sick miners who complained about solicitors taking money from their compensation awards were being "badly let down" by the Law Society. The Law Society then fired back against the ombudsman, accusing them of criticism and saying that 45 solicitors from 10 law firms face disciplinary actions for their handling of miners' claims.
