Personal injury solicitors represent Scottish holiday maker's claim
During June 2005 we received a phone call from a woman who sustained personal injury in a holiday accident in Scotland. She said that she had come across our website and that she wanted representation from one of our expert personal injury solicitors to give her the best chance of getting the compensation that she deserved.
We asked her to tell us the details of what happened in the holiday accident so that we could assess her compensation claim and take it from there. She told us how as an artist herself she had always admired the work of fellow Scot Charles Rennie Mackintosh, the man who designed much of the architecture and many of the furnishings in and around Glasgow. She added that her children had paid for her to go on an all-inclusive Mackintosh tour for her 60th birthday.
After sitting down to map out her journey, the art-lover set out on the drive from the Scottish highlands to Glasgow so that she could view the many sites created and influenced by Mackintosh and his contemporaries. The woman had been to Glasgow with friends before but had never taken the chance to go on the tour and appreciate the whole Mackintosh experience. She saw this as a brilliant opportunity to brush up her photography techniques and do some inspired paintings on the hotel's terrace.
She arrived at her hotel in the early evening and attended a talk about what the weekend tour would include and then went up to her room to unpack her bags. As she entered the bathroom she noticed that the toilet seat looked rickety but as she had just used the facilities in the lobby she left it be and the next morning opted to use the lobby toilets again as she made her way to breakfast.
The next day the woman went by coach on the first part of the trip. As the group made their way to the breathtaking Glasgow School of Art and then to the Willow Tea Rooms for a delicious lunch, a guide talked them through some facts about Mackintosh and the Glasgow Style. On the way back to the hotel they also stopped off at the Hill House in Helensburgh, taking a good look around and plenty of photographs.
On arriving back at the hotel, the woman went up to her room to freshen up. This time she used the toilet in her room, a decision which she soon wished she hadn't made. As she sat on the toilet seat it felt a little wobbly, she tried to straighten it up but as she did so the seat came lose and slipped off the bowl, causing the woman to fall to the floor. She put her right arm out to break her fall but in the process jolted her neck and shoulder and landed on the hard, tiled floor with a thud. While falling, she also twisted her right ankle and hit her left knee with force on the floor, which caused serious bruising. To compound matters, she cut a ligament in her right hand as she tried to support herself on a damaged tile.
After hearing all this and how the lady's personal injuries stopped her from enjoying the remaining two days of her trip, we said that we would take on her claim and help her to get 100% compensation. We assigned her a personal injury solicitor who operates close to her home town in the Highlands. He then went on to fight her case against the hotel, believing it had violated several health and safety laws.
The hotel was found guilty after a court case and an investigation by the Health and Safety Executive and the woman was awarded enough compensation to cover her pain and suffering, medical expenses, inconvenience and for the potential earnings she missed out on while she was not able to paint, as well as a sum to compensate her for the remaining holiday she had missed out on.
