Top-down drivers and UK personal injury solicitors

Some UK personal injury solicitors specialise in representing motoring-related claims, just as others specialise in representing claims for acquired hearing loss; however, a 2009 report in the journal Otolaryngology - Head and Neck Surgery opened up the possibility that it may be possible for the two specialisms to merge.

This is because the study, which looked at the effects on hearing of travelling in a convertible at speeds of up to 70 mph, found that driving top-down exposes drivers to noise levels comparable to those made by a pneumatic drill.

Travelling at a variety of speeds in the convertibles - 50, 60 and 70 miles per hour - the researchers recorded readings of up to 99 decibels - 85 decibels is considered by most experts to be the volume at which a strong risk of hearing loss develops.

However, it was also found that drivers can reduce the decibel level to 83 by simply driving with driving with the windows in the closed position. Nevertheless, the report has led to a debate about whether the drivers of convertibles should wear ear protectors similar to those worn by some motorcyclists.

Dr Mark Downs, from the Royal National Institute for Deaf People, commented, "Noise-induced hearing loss is frequently preventable.

"Regular exposure to noise levels of 88-90 decibels when driving a convertible for several hours a day can lead to permanent hearing loss over time.

"By winding up the windows or wearing basic ear protection, such as earplugs, drivers of convertibles can still enjoy driving whilst protecting their hearing."

Although the report details just one study, it has been noted by some UK personal injury solicitors that any failure of vehicle manufacturers to properly warn of the hearing loss risk inherent in driving top-down could potentially result in affected drivers seeking compensation.
