A no win, no fee claim success for a holiday accident

We received a phone call from a 53-year-old woman who wanted to make a no win, no fee accident claim after she tripped on some steps at a hotel during a trip to Tunisia.

She told us how her husband had recently retired and to celebrate they had booked a two week trip to Sousse, Tunisia. They had never ventured out of Europe before and were looking forward to holidaying in the warm climate and rich culture that the small African country had to offer.

At the welcome meeting held by the couple's tour rep they booked to go on a two day safari. The safari departed five days into their holiday and involved a coach ride around Tunisia, stopping at various places of interest such as the magnificent El-Jem amphitheatre, Berber villages in the Atlas Mountains and the film set for Star Wars, of which her husband is a great fan.

The first day of the trip ended with a camel ride through the Sahara desert then the party were taken to a hotel on the outskirts of the desert sands. After a hearty meal of traditional foods the couple retired and drifted off to the majestic sounds of an African tribe singing and playing musical instruments in the distance.

At 6.00am they were grudgingly woken by an alarm call and went down to breakfast. This was when the holiday accident occurred. They went down the steps to the dining room but the flooring was upturned and the woman caught her foot which made her fall down four further steps and land heavily on the hard floor. She was in a lot of pain, especially in her left leg, and the couple were told that the nearest hospital was many miles away.

The woman had to wait more than two hours before they could find someone to treat her personal injuries. She was taken to a doctor's surgery where she was examined and told that as well as having substantial bruising to her lower back, where she had hit the steps as she fell, she had also suffered a soft tissue injury to her left leg, torn cartilage to her left knee and a sprained wrist. There was little that the doctor could do for her but he prescribed some painkillers and told her to rest. This meant that she could not enjoy the second day of the desert safari and the couple, disappointed and frustrated, were taxied back to their hotel in Sousse.

After a lot of thought, the couple decided that there was little point in flying back to England as the woman would probably get more rest in Tunisia than she would at home. They stayed on but after four days the pain became too much and the woman decided that she would like to go home to recuperate in her own bed.

Their rep organised a flight back home for them which cost an extra 402 on top of the price that they had already paid for their holiday. When they arrived back in England a friend of her husband's recommended that she get in contact with YouClaim. He told her that we are the UK's online personal injury claim experts and that we work on a no win, no fee basis.

Cost-free, hassle-free, no win, no fee claim
The following day she gave us a call. After she told us about her holiday accident we told her how we could help to claim personal injury compensation on a no win, no fee basis. We emphasised that this meant she wouldn't have to pay the fees of her personal injury solicitor in the event that her case was unsuccessful.

We also informed her that she would not be responsible for paying any costs or fees associated with her case, regardless of the case's outcome, as her solicitor would take out after-the event insurance on her request which would cover her expenses.

She said that she would like to proceed with the case and our no win, no fee solicitors set to work. They fought to get the woman the most compensation available for her leg, knee, wrist and back injuries and explained each stage of the claims process to her in plain English. They even provided her with free legal advice. All this made the compensation claim process completely cost-free and totally hassle-free.

The tour operative that the couple had booked through admitted liability for the holiday accident and offered the woman an out-of-court settlement of £8,400 in personal injury compensation. This covered her pain, suffering and distress; medical treatment; travel to the doctor's surgery; flights home and the holiday that they had disrupted by the accident. She was able to keep every penny of the award as we do not believe in taking a cut of our client's compensation for our success fee.
