Fireworks and no win, no fee claims
No matter what the season is, people contact us to help them make no win, no fee claims after they have been harmed at a fireworks display. But it must be said that October and November are the busiest time for these particular compensation claims.
The reason for so many personal injury compensation claims at this particular time of year is November 5th. This date commemorates the same evening in 1605 when a group of catholic conspirators, including Robert Catesby and Guy Fawkes, attempted to blow up the Houses of Parliament to kill protestant king James I. The plot was unsuccessful and the perpetrators caught but any such disaster in the present day would have no doubt had consequences such as no win, no fee claims for compensation.
With this in mind, it is paramount that organisers of firework displays take extra care when it comes to health and safety, with regard to both storing and using fireworks. The Health and Safety Executive (HSE) and local authorities such as Trading Standards Officers work very hard to enforce firework legislation in order to protect those who purchase fireworks and those who attended firework displays.
Storing fireworks
Under the Manufacture and Storage of Explosives Regulations 2005, individuals are allowed to keep as much as 50 kg (net) of hazard type 4 fireworks (the less powerful varieties usually sold at retailers) for up to 21 days, as long as these are not for sale or use at work. For those wishing to store larger quantities of more powerful fireworks for commercial displays it may be necessary to register with the local licensing authority. A registration certificate may also be needed when buying more than 50 kg of fireworks.
Using fireworks
Firework displays where people, such as pyrotechnicians, work with fireworks on a professional basis are covered by the Health and Safety at Work Act 1974. It is important that anybody employed to handle fireworks at an organised event has had proper training so as to avoid having a work accident and ending up making a no win, no fee claim.
The HSE provide useful literature, such as Working Together on Firework Displays, a safety guide for firework display organisers and operators www.hse.gov.uk.
