A successful no win no fee claim scenario

Since the abolition of legal aid for personal injury cases, making a claim as part of a no win no fee agreement has been the only way that most could pursue the compensation that was rightfully theirs.

When you make a no win no fee claim through YouClaim we not only guarantee that you will not owe a thing to your solicitor in the unlikely event that your case is unsuccessful, but we also guarantee that you will not have to pay a penny towards any costs and fees accumulated as a result of your claim.

Further to this, we promise that when you win your claim you will receive 100% compensation awarded to you as, unlike some personal injury law firms, we will not take a cut. Now you can't say fairer than that.

A not so pleasant afternoon walk
While out walking with her husband one Sunday lunchtime a 49-year-old woman from Berkshire tripped on a loose paving slab. She sustained a serious personal injury to her hip and contacted our claim advisors to enquire about making a no win no fee claim.

The couple had just finished their roast dinner and had decided to take a leisurely walk to the local park. They were walking side by side along the pavement of a nearby street when the woman stopped to smell some honeysuckle that was climbing up a neighbour's hedgerow.

Her husband had not realised that she had stopped and continued to walk a little further. On turning to catch up with her husband, she tripped and fell awkwardly on the pavement. The woman's husband heard her cry out and turned to see her hit the floor heavily, with a thud. She cried out again, this time in considerable pain, and began to scream, "My hip, it's my hip".

Clearly, very shaken up by seeing his wife in such distress he stood dumfounded for a few seconds. A neighbour had heard the commotion and asked if he wanted her to call an ambulance, he said, "Yes that's very kind, I don't know what happened, I think she's hurt her hip."

The ambulance arrived in due course and the medics seemed concerned at the state that the woman was in and the position in which she had landed. They were very cautious when moving her and eventually got her into the ambulance without causing her any further discomfort.

She was taken to the Royal Berkshire Hospital and after a thorough examination was diagnosed with a fracture to the hip that was likely to need a hip replacement. She underwent surgery but the hip replacement was found to be only partially successful and it was suspected that further surgery may be required. The woman had another operation performed and sustained even more pain and discomfort as a result.

Meanwhile, her husband had re-visited the place where her tripping accident had occurred as he was suspicious to why his usually agile wife had taken such a tumble. On his return, he discovered that the area of pavement where she had tripped was severely uprooted and cracked. He also discovered, on talking to other local residents, that there had been several complaints made to the council about the state of the pavement but no action had yet been taken to repair the damage.

He then contacted the council to inform them of his wife's hip injury and found that they were neither helpful nor understanding and would not commit to when the pavement would be fixed. When he went to visit his wife after her second operation they discussed whether they should make a public liability compensation claim against the council and agreed that it was the rightful and responsible thing to do.

Seeing as they had already lost one incoming wage for the foreseeable future, they were not keen to lose any more money so they went about finding a way to make a cost-free personal injury compensation claim. They came across YouClaim while searching on the internet and discovered that we not only offer a no win no fee policy but also guarantee a totally cost-free service.

The wife gave us a call straight away and told us about the circumstances surrounding her accident and how her husband had approached the council to no successful end. We agreed to take their case on a no win, no fee basis.

Our personal injury solicitors provided the couple with free legal advice and built a strong case. Before long, the council admitted public liability and also admitted that their negligence in the repair of the pavement had been a direct cause of the woman's injuries. She was awarded £24,400 and the case did not even have to go to court.
