No Win, No Fee, youclaim.co.uk

Why some no win, no fee claims can still end up eating into your compensation

While YouClaim protects you from all expenditure relating to your no win, no fee claim, this is not true of all organisations. YouClaim believes that you should not be laying money out if you deserve compensation, and therefore list here a variety of costs that you may be asked to pay by other firms that claim to offer a no win, no fee service (also known as a conditional fee arrangement).

When a no win, no fee claim is successful
A successful no win, no fee claim will generally be followed by a request for a fee by the claimant's solicitor for their work on the case. Although the court will often charge the legal costs of the winning side to the loser, in some cases the full amount of this is not given and the remainder must be paid for out of your compensation award.

Similarly, some no win, no fee solicitors also charge a success fee, which may not be entirely covered by the final decision in court, and may thus end up being a cost to you.

YouClaim believes that it is your compensation, and therefore offers a 100% compensation promise to support the people who make a no win, no fee claim through them. There are no costs, fees or deductions whatsoever.

When a no win, no fee claim is not successful
While the no win, no fee agreement means that you will not pay your solicitor's fees if your claim is not successful, you may still be liable for various expenses, such as court fees, and quite possibly the winning side's legal costs.

Once again, YouClaim will not pass these costs to you should your claim be unsuccessful. In this unlikely event, you will not have to pay a penny due to our ATE insurance.

Insurance against losing your no win, no fee claim
It is possible to take out after-the-event (or ATE) insurance against your no win, no fee claim causing you costs, but the premium for this is itself a cost. Some personal injury solicitors will force their clients to take out this kind of insurance themselves before agreeing to represent them.

With YouClaim, ATE insurance is undertaken by the no win, no fee solicitors for every claim they take on. There are no costs to you for insurance. Read more about ATE Insurance.
