Teacher with back injury awarded £7,500
after school discriminated against her

A teacher who suffers from chronic back pain after a bad back injury has been awarded £7,500 after the school she works at failed to adapt her working conditions. When the teacher was well enough to return to work her doctor advised her that a number of changes should be made to her working environment and that she should be recognised as disabled due to her back injury. The school failed to recognise that it was painful for her to stand for long periods of time but did not do anything about it.

When her employers failed to comply with the changes she requested she took legal action against the north Belfast primary school. The case was settled outside of the tribunal and the employer recognised that they had not acted in accordance with the disability discrimination act.

Employers not only need to protect their staff from work accidents they also need to make sure that the working environment meets the correct standard for disabled employees.
