Suspected bogus claimants go to Court

A 26 year old man from Wales is the first person to go to the High Court over allegedly falsifying a statement when making a personal injury claim.

He claimed that the Merthyr Local Council had been negligent in the upkeep of their property, and that he had slipped or tripped as a result, causing him injury. He started a personal injury claim against the Council, who believed his claim was fraudulent and instead believed that he received his injury whilst playing football.

They have in turn started legal action against Mr Hughes and two witnesses for making a false statement in a document that has been verified by a statement of truth. A statement of truth is a formal statement of evidence, previously known as a sworn affidavit, and if it is found that someone has given a false statement, they can be charged with contempt of Court.

A BBC investigation found out that Local Councils believe that up to 70% of the slip and trip claims that are brought against them are false. Councils in Wales have been trying to cut back on money spent on personal injury claim costs, and have set up a Fraudline for people who believe that someone they know is making a false claim.

It is thought the case against Mr Hughes could be an important step in denying false personal injury claims.
