£300 compensation for spam won

A British business man has won a groundbreaking spam compensation case where he was awarded £270 and £30 in fees.

Nigel Roberts claimed for compensation after receiving persistent junk emails from a marketing company, Media Logistics. Roberts, who spoke of his triumph on BBC’s Watchdog last week, revealed how he wrote to the company asking why they had targeted him with these emails and did not receive a response.

He proceeded to claim damages under the Directive on Privacy and Telecommunications. This was the first compensation case of its kind in the UK following new European laws which specify that a company can be sued for sending unwelcome emails.

Media Logistics agreed to pay the compensation claim to the business man in an out of court settlement.

It has been commented that he has won quite a small amount of compensation seeing as he only went through a small claims court and it is thought that he could have won a larger amount had he proceeded through the higher courts. However, Roberts maintains that it is not about the compensation amount but about stopping spammers from invading our inboxes.

Roberts said this of his compensation claim case: ‘This case does provide a guideline when it comes to successfully claiming damages from spammers. It also shows that wherever they are they can be held responsible for sending spam to anyone living in a British Isles jurisdiction.’
