Many personal injury solicitors have been urged to refund the money charged to miners for the ‘free’ legal advice given during their personal injury cases. An independent review has called on the legal profession to deal with the issue of refunds. Under a government scheme, miners who have developed industrial illnesses through their work are compensated and have their legal fees paid.
There have been complaints from around 1500 miners who have been charged twice during their personal injury case. They were not told that the government paid legal fees so the money was deducted from their compensation wrongfully.
The Union of Democratic Miners formed a separate firm called Vendside to handle compensation claims. The Department of Trade and Industry (DTI) has paid Vendside to handle claims and the already more than £158 million has been secured for 29,000 miners and their families.
Under the scheme to compensate miners for their industrial illness the government has paid out £8 billion to 750,000 miners and their families since 1999. This is one of the biggest work accident compensation agreements the world has ever seen.
