Personal injury claims threaten equine industry
A horse breeder has revealed how a compensation claim settled by personal injury solicitors almost put her out of business.
Marcia Pendlebury, owner of the Pen-Llyn Lusitano Stud and Riding Centre in Wales, said she was desperate to contest the personal injury claim but it was settled anyway, leaving her with a ‘black mark’ against her name.
As a result, her insurance premium trebled to 12,000 and she was forced to shut the centre for several weeks after her insurers said they were no longer providing equine cover.
The personal injury claim in question was the result of a horse riding accident that left a woman with a broken ankle. The accident did not take place at Ms Pendlebury’s stud farm, but happened at the home of a customer who had just bought a horse from her. The woman subsequently blamed the stud, claiming that the three-year-old stallion was untrained.
63-year-old Marcia Pendlebury criticised solicitors for settling the personal injury claim without her permission and has taken her complaint to both the financial ombudsman and her local MP, Hywel Williams.
She said, "I had stated at the beginning that on no account must they settle.
"When we take out insurance we do not realise that we sign away the right to defend such a claim.
"When I started this business 30 years ago I did it to bring horse riding within reach of everyone and prevent it- as it was when I was a child- being an elitist sport."
The mother-of-two also added that she feared for the future of horse riding, saying, "The equine industry is in crisis and we are going to have to go to Parliament."
