Parkinson’s compensation claim in US sets precedent
A $1m (£580,000) settlement has been awarded in the first successful compensation claim for Parkinson’s disease to be seen in the US.
The compensation claim was brought by a welder, Larry Elam, who developed Parkinson’s disease and believed that it was caused by his job. The case was found in the claimant’s favour in 1993, but the defendants appealed.
The judge in the December 2005 appeal, Appellate Judge Goldenhersch, ruled that there was adequate evidence to prove that there was a link between manganese fumes and Parkinson’s disease, and that the claimant had developed the disease as a result of his work.
There were three defendants in the personal injury case: Lincoln Electric, Hobart Brothers, and the BOC Group, a UK firm. The BOC Group were unhappy with the judgment, describing the case as “an aberration”.
There are to be many more compensation claims similar to this that are being brought by welders in the US. A litigation report from September 2005 says that at that time there were 8,574 people claiming compensation from the BOC Group.
